Ahmednasir: If Supreme Court orders presidential re-run, it’ll happen in 2025

The Supreme Court is expected to determine the Presidential election petition filed by former Prime Minister Raila Odinga.

As such, the Supreme Court has until Monday, September 5, to deliver its verdict.

According to Kenyan law, there are only two options expected to be made and lawyer Ahmenasir Abdullahi has weighed in on the dangers of one of the outcomes.

The court will either uphold William Ruto as the fifth president-elect or invalidate IEBC’s results that declared Ruto as the president-elect and either order a rerun or recount of votes.

According to the Constitution of Kenya 2010, if the majority of the seven judges find that the August 9, presidential election was not done in accordance with the law, then the judges will call for a fresh election within 60 days.

However, city lawyer Ahmednasir Abdulahi has alleged that the repeat of presidential elections might not happen within the stipulated 60 days in the event the Supreme Court rules in favor of Raila Odinga’s petition.

In a statement on Thursday, August 25, the senior counsel alleged that Azimio la Umoja One Kenya Coalition party flag bearer Raila might occasion delays by calling for reforms at the electoral body Independent Electoral and Boundaries Commission (IEBC).

“If the Supreme Court orders a re-run, Kenyans will go to the polls in 2025. Uhuru will not allow a re-run in 60 days. They (Azimio la Umoja One Kenya Coalition party) will demand ‘Chebukati must go’ and IEBC is reconstituted,” Ahmednasir said in a Tweet.

He further claimed that the outgoing President Uhuru Kenyatta who is serving his final term in office according to the Constitution is seeking to extend his stay in power through back doors.

“President Uhuru desperately wanted two extra years. He will get it and fragile Kenya will shatter,” he said.

On Monday, August 22, Raila Odinga and his running mate Martha Karua filed a petition at the Apex Court in which they claimed that William Ruto was illegally declared the presidential election winner.

In their 72-page petition, the Azimio team stated that in the Tuesday, August 9, presidential election, IEBC chairman Wafula Chebukati willfully subverted the sovereign will of the majority of Kenyans and overthrew the constitutional order by declaring William Ruto the president-elect.
