Attention turns to Attorney General as courts dismiss his legal advice to President Uhuru

by Nderi Caren

Attorney General Paul Kihara is the legal mind behind president Uhuru Kenyatta, but is he giving him the right advice?

Lately, the court has been squashing most of President Uhuru’s legal decision that he has announced through gazette notices and executive orders.

Uhuru’s name has been a topic of discussion in the corridors of justice, with law suits tabled against him, one after another.

Because of this, Lawyer Ahmednasir Abdulahi today challenged Attorney General Paul Kihara over his efficiency.

“I call upon Hon Justice (rtd) Kihara, the Attorney General of the Republic of Kenya to honorably resign. Either you are incompetent or H.E Uhuru has no time for your legal opinion. The High Court has nullified every major decision Jubilee/Uhuru made in the past 4 years!!!!” he argued.

Ahmednasir aka Grand Mullah’s opinion was influenced by the court cases that Uhuru has faced in the recent days.

On June 1, the High Court ruled that President Uhuru’s Executive order No 1, seeking to place the judiciary and its tribunals under the executive is unconstitutional.

Before this, the High Court, on May 15 nullified the BBI report which is a brain-child of President Uhuru and his handshake partner, Raila Odinga.

“The constitutional amendment Bill is an initiative of the president and the law is clear that the president does not have the constitutional mandate to initiate any constitutional changes through popular initiative,” a 5 member bench ruled.

After the ruling, Attorney General Paul Kihara moved with speed to defend his boss by filling a petition at the Court of Appeal.

The petition is yet to be heard and BBI Reggae is on a pause.

Another instance that proves Kihara misadvised the president is the court order banning the transfer of the Kenya Meat Commission to the Ministry of Defence.

The order by Uhuru was squashed by Justice Anthony Mrima, even though Uhuru went ahead to oversee the transfer.
