Musalia Mudavadi’s party sues ODM

Amani National Congress party ANC has sued the Orange Democratic Movement over for orchestrating the removal of Kakamega senator Cleophas Malala as the senate deputy minority leader.

The Mudavadi-led party in its case filed on Monday, April 12, accused ODM of breaching their accord after kicking out Kakamega senator Clephas Malala and his position taken up by Kilifi Senator Stewart Madzayo.

According to court papers filed by JSG Law LLP, it was never envisaged for a constituent party under the National Super Alliance to abuse its numerical strength in either houses to bully and dictate who holds leadership positions in Senate and national assembly.

“It was never envisaged under the coalition and power-sharing agreement that a constituent party would abuse its numerical strength in both Houses to bully and dictate who holds leadership positions in the National Assembly and Senate,” the suit papers read.

Malala was kicked out on Wednesday, March 24, as Senate deputy minority leaders, a decision reached during a NASA Parliamentary Group meeting convened by Siaya Senator James Orengo.

About 20 ODM senators appended their signatures to have Malala kicked out from the office. Mudavadi’s party lacked numbers to stop the move.

The former Member of county Assembly attributed his removal to ODM’s loss in the Matungu by-election where Amani’s candidate Peter Nabulindo won.

“ODM invested heavily in the Matungu by-elections; unfortunately, we outshone them. They are still nursing their injuries from the by-election loss. I believe they were not happy with me and they thought I was the pivot of ANC support, but I take it happily and courageously and I hope to move forward,” Malala told KTN News.

Other parties under the NASA umbrella including Ford Kenya have since condemned ODM for the move terming it “selfish.”

Malala had earlier on said he would not castigate ODM so much since it’s the party that natured him.
