Petition filed to remove IEBC commissioners who tried to block Ruto’s presidency

Four break-away IEBC commissioners differed with their chairman Wafula Chebukati for the second time on Tuesday, September 28.

The Farmers Party has presented to the National Assembly, a petition for the removal of four renegade IEBC commissioners.

Commissioners Juliana Whonge Cherera, Irene Massit, Justus Nyang’aya, and Francis Wanderi walked out of the Bomas of Kenya where presidential results were being tallied just minutes before the announcement of presidential results on Monday, August 15.

The four ‘opaque’ commissioners headed to a Nairobi Hotel where they issued a statement disowning the results that were to be announced by IEBC chairman Wafula Chebukati citing a lack of transparency.

They later filed a petition challenging the presidential results announced by IEBC chairman Wafula Chebukati where President-elect William Ruto garnered 7.1 million votes against Raila Odinga’s 6.9 million votes.

The farmer’s party now wants the four removed from office for attempting to block William Ruto’s presidency.

The party expressed the conduct of the commissioners as being a “gross violation of the constitution and a breach of their oath, which denies the 4 commissioners their legitimacy to hold the state offices as commissioners of the IEBC.”

“In line with Article 251 of the Constitution, a petition for the removal of 4 commissioners of IEBC following the attempt by the said Commissioner to sabotage an election process as witnessed on Monday, August 15, at the Bomas of Kenya,” the party said in a statement on Friday, September 9.

According to the Constitution of Kenya 2010, once the petition is deliberated by the National Assembly, the petition will be presented to the President for the appointment of a tribunal for the removal of the commissioners under article 251(3) of the Constitution.

“The National Assembly shall consider the petition and, if it is satisfied that it discloses a ground, shall send the petition to the President,” the Constitution states.

It is worth noting that Kenya Kwanza Alliance controls both National Assembly and Senate thus it can pass any motion it desires once before either of the houses.
