William Ruto celebrates court ruling on BBI bill

Deputy President William Ruto has covertly celebrated court’s decision to declare BBI bill process unconstitutional.

In a social media post, the DP who has been against the push to amend Kenya’s 2010 constitution, said there is a ‘God’ who loves Kenya.

“There is God in heaven who loves Kenya immeasurably. May God’s name be praised forever,” he posted.

Ruto’s post came few hours after a 5-judge bench unanimously declared BBI Process and Constitutional Amendment Bill 2020 unconstitutional, illegal, null and void.

The decision came as a shocker to many considering both houses of parliament voted majority to endorse the bill.

In what many have interpreted as a move to defend the constitution, the judges said seen to defend the constitution and sovereignty of the people of Kenya, the judges termed the BBI steering committee unconstitutional.

Judges Prof Joel Ngugi, George Odunga, Jairus Ngaah, Teresia Matheka and Chacha Mwita said Uhuru does not have the power to directly initiate constitutional amendment under the law, only parliament can do that.

“It is our finding that popular initiative is a power reserved for Wanjiku neither the president or any other state organ can utilize article 257 to amend the constitution,” said the judges.

It remains to be seen whether or not the state shall appeal the decision considering the constitution mandates election’s body to conduct a referendum one year before a General Election which is 2022.
