by Enock Ndayala

Homa Bay Town Member of Parliament Peter Kaluma is intending to table a Bill that proposes severe penalties for gays.

In a notice of motion to the National Assembly Speaker Moses Wetang’ula, the vocal legislator termed wants the Lesbian, Gay, Bisexual, Transgender, and Queer (LGBTQ) community handed commensurate sentence.

“I intend to bring legislation to criminalize and punish homosexuality and other unnatural sexual acts and to further criminalize the promotion of such acts in Kenya,” partly reads his notice to the Speaker.

While terming homosexuality as an unnatural act, the ODM legislator said that homosexuality was a threat to the country’s future generation.

He further noted that the proposed law is intending to further the provisions of Article 45(2) of the Constitution of Kenya to protect the family.

“The proposed law intended to further the provisions of article 45 (2) of the Constitution of Kenya and to protect the family will not only consolidate all existing laws relating to unnatural sexual acts to imprisonment for life or commensurate sentence,” adds the notice.

Kivumbi.co.ke understands that Article 162 punishes carnal knowledge against the order of nature with up to 14 years in prison.

However, the Atheist Society in Kenya has protested the introduction of Peter Kaluma’s bill that seeks to impose a life sentence for homosexuality and those promoting the act.

The Atheist accused the lawmaker of fueling repression with respect to sexual orientation.

“What you are doing is fueling the repression of a marginalized community in Kenya. We expect you to be a promoter of gender diversity with respect to sexual orientation,” they said.

This comes at a time when the Supreme Court in a landmark ruling allowed the National Gay and Lesbian Human Rights Commission to be registered as a legal NGO.
