Win for ex-CS Fred Matiang’i as DPP drops his case

Former Interior CS Fred Matiang’i appeared before the Director of Criminal Investigation (DCI) just days after jetting back from the diaspora.

The DCI submitted recommendations in an inquiry file dated March 7, 2023, that Fred Matiang’i and his advocate Danstan Omari be charged with conspiracy to commit a felony and publication of false information.

“…between 8th February 2023 and 9th February 2023 at Karen Ngong View Estate within Nairobi County in the Republic of Kenya with intent to cause panic, chaos or violence among citizens of the Republic of Kenya jointly with another published in the media that his house had been raided by a battalion and or Garrison of Police officers intending to arrest you a fact you knew to be false,” the charge sheet read in part.

However, on Monday, March 13, the former powerful Interior CS breathed a sigh of relief after the Director of Public Prosecution (DPP) dropped his case.

In a statement, DPP deputy director Lilian Obuo said the evidence availed by the DCI was not sufficient.

“The evidence provided did not meet the ingredients needed to prove each of the fore- mentioned offenses as required by law,

“The Director of Public Prosecutions has therefore directed the Directorate of Criminal Investigations to close the inquiry file with no further police action,” the statement read in part.

Obuo stated that the evidence provided did not find a concrete reason to charge Maiang’i and his lawyer Dansto Omari.

“The Director of Public Prosecutions found that the evidence provided was not sufficient to sustain the above charges against Fred Okeng’o Matiang’i and his advocate Danstan Omari,” the statement added.

The drop in his case happened just a day after attending a Gusii leaders meeting chaired by Education Cabinet Ezekiel Machogu.
