Raila writes to ICC demanding investigation into conduct of prosecutor Karim Khan

Azimio la Umoja One Kenya Coalition party leader Raila Odinga has written to the International Criminal Court (ICC) demanding a probe into the conduct of its prosecutor Karim Khan.

In his letter to the ICC head of Independent Oversight Mechanism, Raila through his lawyer Paul Mwangi accused Chief Prosecutor Karim Khan of gross misconduct.

In the six-page document dated Wednesday, August 16, Raila alleged that Khan neglected his official responsibilities and had gone to bed with the Kenya Kwanza government.

Raila further accused Khan, who represented William Ruto during the 2007-2008 polls chaos trial of breaching ICC ethical standards, conflict of interest, lack of transparency, and undermining the court.

“Until August 8, 2023, as will be narrated later in this petition, there has been no official recusal of Mr. Khan from the four pending matters stated above nor any known application on his part to the Presidency of The Court to be excused from the situation in Kenya as is contemplated by Article 42(6) of The Rome Statutes,” the letter read in part.

The prosecutor who was feted for his immense contribution to the promotion of justice and humanity was in the country earlier this month where he received an honorary Doctor of Laws degree from Mount Kenya University (MKU).

His visit saw a section of Azimio leaders cast doubts on his visit saying his visit could interfere with their case at the court.

“ICC prosecutor Karim Khan’s hosting in Kenya this weekend by Mount Kenya Uni and its founder a friend of his former client William Ruto at a time both the Azimio and Kenya Kwanza regime have written to ICC on the situation in the country, especially the killing spree of unarmed protestors by police is not only suspect but also a blot on the credibility of ICC,” Azimio principal Martha Karua said.
